I get so sick and tired of people labeling themselves as XXXXXX-American. Be you African, Chinese, Mexican, what-the-fuck-ever. If you immigrate to this country, you are an AMERICAN, no other tags allowed.
Having pride in one's ancestry is one thing, but this is ridiculous.

In this instance, Cinco de Mayo, or the "Mexican Independence day" is a MEXICAN holiday, not an American holiday.

I agree, you should be allowed to wear a shirt with whatever flag you want on it....That's what part of being an American is....However, if those boys were doing it as an act of trying to be smartasses, I can kind of understand why the Vice Principal would chose to tell them to take them off.......Either way, they should have been allowed to wear whatever they wanted, but it almost seems as though they were trying to instigate something.... That's where the problem comes in and the teachers were probably just trying to keep the peace. I hate when people try to be assholes or racist, those boys might have done it just because it was Cinco de Mayo. The problem isn't the fact of whether they were not allowed or were allowed to wear the shirts, but it almost seems like they were trying in their own little way to say "fuck you" to the Hispanic population. Lets face it folks, racism is still a major problem in this country. The question is, how often do those boys wear those "American Flag" shirts? I think they were being typical racists.

It doesn't matter if they were trying to be little douches to the "mexican" kids. They were wearing the AMERICAN FLAG. Unless they were actually starting fights with the mexican kids it doesn't matter. NOBODY should ever be able to tell them that they can't wear the american flag. EVER.

This is another case of discrimination against whitey that will go unpunished.

I agree, but I think the teachers made a judgment call. It's like showing up to a Michigan football party with an Ohio state shirt on, there's gonna be problems. Not saying that guy doesn't have the right to wear the Ohio state shirt, but for sake of keeping the peace, someone would probably be like "hey take the shirt off or leave because you're abviously trying to cause problems." I think the media is playing into "it was an American flag shirt" too much. It was mote about just keeping the peace because the teachers recognized the fact that the kids were being pricks.

But it is their right to do what they want. One point I can see is that if the mexican kids decided to start a fight with the kids wearing the american flag shirts, then it is their fault not the kids with shirts. Yeah the faculty may have been trying to prevent something but this isn't Mexico and we don't have to observe Cinco de Mayo. They moved here to our country legally or illegally. Personally the illegal immigrants are the biggest problem we are having in this country. They want rights but yet don't want to adhere to our countries policies.

It doesn't fucking matter. There wasn't any precident for the objectionable actions by the principal. There wasn't any history of violence or incidents caused by kids wearing American flag T-shirts. This is a cut and dry case of discrimination against the white kids.

Pay attention to this part

Eugene Volokh, a professor of law at UCLA, said the students are protected under California Education Code 48950, which prohibits schools from enforcing a rule subjecting a high school student to disciplinary sanctions solely on the basis of conduct that, when engaged outside of campus, is protected by the First Amendment.

If the school could point to previous incidents sparked by students who wore garments with American flags, they could argue that the flag is likely to lead to "substantial disruption," Volokh said.

"If, for example, there had been fights over similar things at past events, if there had been specific threats made. But if just say, 'Well, we think it might be offensive to people,' that's generally speaking not enough."

Volokh said the students and their parents likely have a winning case on their hands if they decide to take the matter to court.

"Oh yes, it's almost open and shut," he said.


The other KEY piece to this story is the principal that made the decision to send the kids home.

Being a hispanic principal and telling white kids to go home or take off their American flag shirts looks REALLY suspect. Even if his intentions were honestly for the good of the school, it won't hold up in court. Currently he's very lucky that the families of the kids have decided to not sue.

I am right there with you guys, but I think the principal made the right decision in that situation.... Had there been no reason at all, and he sent them home, you bet your ass I would have been arrested. Racism has really started to come out of the woodwork lately I have noticed. The original people for this Country ( OUR Country) were the Indians(Native Americans) and we all know what happened there. Everyone else came into this County in some other form. One should look at their own ancestry as many can trace illegal immigration into this country. For example, how many of our ancetry came from Germany, Ireland, etc. It is interesting how some can look ...... A lot of us will find that we are almost all the same in one way or another and we need to get over our differences.
