#6262, "A question about law......"

LAST EDITED ON 12-Jun-01 AT 02:30 PM (PST)

I just made a call to the shop who installs my HRC turbo kit, and asked them can I pick up my car on Thursday for sure...They said it should be done but not sure...@#%$ coz they don't sure they already got the part ordered for me yesterday...I just wondered..Hahn said" Hahn RaceCraft Turbosystems are complete installation packages, with all the needed components included"
why did they still order couple parts for me????? and since I dropped my car on 6/1, it almost have been taken two weeks to install it....
So, I have questions about law here, does the shop need the license(I don't know what kind of license) to install or modify my car ? what license is it? and if they need it, but don't have it, can I take back my car without paying any money? Coz I don't think they have the license!!any guys know about this aspect of law ? plz give me your suggestion!!I really need your help!!Thanks!!
I think it's time to revenge!!

I don't know about laws.. but If you wanna get into it a lil. then call your shop and ask specially what parts were required.. and if they are gonna charge you more for it, Did YOU order the kit?? or did the SHOP ordered it?? anyways... if you did then find out about the parts and talk to bill or call customer support. I don't know why.. but I think a self turbo install is mandatory, because You get to know what's going on in there.

Find out what parts were ordered and why, then call up hahn and see if you can find out if they really order them. I'm sure hahn would of supplied everything you needed to install it, and if they did'nt they would of shipped the parst out to you for free i would assuem. and if the shop installed parts without your concent (signiture) then you don't have to pay for them.

Just don't let them push you around, if you have to, go to the local tv station and ask for help they love to expose crooked business.

later,
robby

Yeah im pretty sure you cant operate any business with out a licence, I dont think the mechanics have to be ASC Asceritifed but the owner must have a business licence to run a shop.....Secondly if you think about it though you cant be a lawyer with out a law degree and you cant be a doctor with out a degree....So how come you can be a mechanic with out being certified...........if it turns out that the person who is working on your car is not certified and the law says he must be..then any contract you signed with the shop is void. and you should get all monies you paid out Talk with a lawyer (dont sign anything else)

...and we agreed that I would install the kit for $200, and didn't have a ASE certification to work on cars, do you think you would not be required to pay?

The two professions you noted, doctor and lawyer, do in fact require licenses in which to practice. However, you may be surprised to learn that most professions do not. The mechanic may indeed be required to have a business license to have a "shop." But he may not. This law differs from jurisdiction to jurisdiction and if he's the type of guy who doesn't bring in a lot business (only does it on the side), the very contrary may hold true.

Bottom line though is that, if you agreed for him to do the work as specificied in the contract and he performed it as described, I'd bet that most courts would hold you liable. (business license or not) Remember, that's the government's business to require/enforce him to have a permit. He may be subject to some sort of fine, but a writing between two parties where consideration flows both ways is a "meeting of the minds" and otherwords a valid contract. The mechanic also may have redress to hold your car under a mechanic's lien provision until you pay.

Analogy: Someone is driving around without a license and you negilgently hit him. Expect to still be liable for damages. The state has the right to fine the driver for driving without a license, but if you negigently hit him, don't expect him "driving without a license" to be an excuse for your own misdeed.

I agree with Jason...don't think you don't have to pay them anything just because they don't have a license. But don't pay extra money for parts they clam to have installed when in fact they didn't. Are they charging you extra for these parts?? If they are, ask what extra parts they had to get, and ask to see them. Then find out if they were included in the kit. If they were, get proof, and then continue not to pay for them.

Then if those parts WERE included in the kit, they probably broke or lost them. So in turn, it's their falt your car has been there for over two weeks. Do something about that, don't let them push you around. It doesn't take two weeks to install a turbo kit!!!!!!!

I'm not at all saying that you may not have to pay them (the entire amount). If they did a job in which you didn't agree, such as...

1) do a subpar job
2) do something extra you didn't agree
3) do anythign outside the scope of what you and he had agreed upon...

...those may be grounds to dispute the amount and take them to small claims court. The best course of action here is to pay them the full amount, and then sue. Make ure that when you do pay them, to include onthe receipt that you "DISPUTE" the amount in question. Then go to your local county courthouse and get a small claims court form and ask the clerk on how to proceed. Make sure to keep copies of ALL your documentation. For instance, any proof that the mechanic is not certified will probably lend some credibility that he may be doing some "questionable" work.

Don't let anyone push you around guys. Just because you're young doesn't mean the Court will look at your case any less importantly.

Good luck!
