#43218, "Ripped off..."

I got ripped off to the tune of $550 on SRTForums. Paid for an S2 PCM / Sensors, and got their OEM counterparts instead, a net loss of about $500. Anyway, PayPal won't do anything since I received something for the seller. (Even though everything was wrong, and worth substantially less.) Now, this guy is a Canadian citizen. I plan on filing reports with my local law enforcement, and his. Also, I'll file complaints with the NCA's fraud protection division. Aside from that, can you guys think of any other avenues I've forgotten to explore?

If you really want to be mean. Call the dutyfree post toll boothes along his us/candaian boarder. Give them his name, tell them some make up crap that he's drug dealer and suspected something wrong with him. They'll pull his butt over within minutes and also do search/seige. The boarder patrol would stripped his car apart, looking for drugs, if they don't find anything they'll let him go within a time frame. Or have them give the guy a full body cavaity, search. He wouldn't pull that again, guarantee. Rofl.

My father was a truck driver and I have cousins work at certain toll boothes. They've told stories about it and I seen it happend a few times.

Again, an interesting thought... But not at all helpful. I'm not trying to be vengeful, or break the law. I only want compensation, be it in the correct product, or my money back.

You got hard evidence that you purchase should of been what you should of got and not what you actually got? As in writing? That would be the only evidence really.

You paid with your credit card through Paypal? File a dispute through your credit card. They will make you whole again.

Paypal might not like you for a while, but fuck 'em. You paid for something and did not get it. The other side of the shoe, since Paypal is semi-related to Ebay, if you listed ABC for sale on Ebay, but the buyer said they got XYZ, you'd take the hit.

They know it's wrong. Just because the seller shipped *something* doesn't make it right. Before you call the cops, call your credit card company. It's probably the only recourse you've got.

International police involvement isn't going to do shit for $500 worth of Neon parts. That's small claims right there. Maybe you can spend a day in small claims court, win an award, and never see a dime because they have no authority in Canada. On the other hand, you could fly up to Canada and try to do the same there, but you're not a citizen and so probably have no rights north of the border.

Sucks, man, but it is what it is. Get it back from your credit card, or sell the shit on Ebay, and chalk up the rest to experience.

Report him on the forum, someone probably lives in his area and will give him shit. Not helpful in the recourse action but if you make it hard enough on him he might just make you whole to get out of the hassle. Definately file a complaint with your credit card company, that is your best bet.

Get a lawyer and take him to small claims court, you do have case. I was being sarcastic, from my other post.

prob about small claims court is the cost. You go for 500 and after costs for lawyer and court fees, you might see what you paid for those parts.

It's small claims court. Lawyers aren't allowed and the loser pays the court costs.

Doesn't matter since the damn seller is in CANADA.

Ronin is correct, re-read the original post, guys. Seller is a Canadian citizen. Anything less than between $1,000(US) isn't going to matter to the police or state department, in earnest.

Look outside the "OMGz U should killz this guy!!!1!!!one!1!"

Think about this logically:

Me filing a report with the NCA's fraud prevention bureau, and with the FBI puts a red-flag on both his e-mail account, PayPal account, and his CREDIT HISTORY/SCORE. Obviously the latter is the most important, if you've ever applied for a credit card, you'll know why.

In short, I don't want to defame this guy, I don't want revenge. I just want my money back, or the product I paid for.

The vast majority of you know me, and you know I do straight business; I just want the matter cleared up. If there are any intelligent avenues I haven't explored, I want to know about them.

Did you actually open a dispute through Paypal's resolution center? There's a specific option for "item's that were not as described" in there...that is if you're still in the time frame for it. Hope you get it sorted out.

The threat of legal defamation works more often than not.

Why did Paypal side with the seller? Details? Since you haven't replied to Driggsy I'm assuming your Paypal is tied to your checking account and can't do a chargeback. This is why I stopped buying/selling on SRTForums. Even after 6 years nothing has changed.

this is exactly why I document everything that was said, and always pay with a CC. paypal sucks for resolving disputes anyway. CC chargeback FTW

yup. paypal will by default deny your claim, but the CC agency will get your back. I've only done it once, but many others have as well w/ much success.

paypal disputes are catered towards ebay buyers/sellers. hell, they're an ebay subsidiary. one big happy monopoly

Had one situation where I got burned by a guy who said he was going to send me a turbo mani and it was cracked and fucked up (though pics and claims to the contrary by the seller. Obviously a different manifold). Filed with Paypal and they basically said, you got something from the seller, you are SOL.

Sooooo, because I buy using my credit card (which paypal doesn't like), I sent them a note to kick Paypal's ass. Credit card wins. I've put in disputes with my CC company over a couple more items throughout the years. CC disputes FTW.

I had a similar incident on ebay, bought a center console for an AE86 that I had and the seller dropped off the face of the earth for over a month. Wouldn't respond to my emails. Filed a dispute and the next week I suddenly had a center console.

Of course if paypal is being a bitch then filing a claim with the CC company or your bank is the way to go.

Here's a little insult to injury:

I got a BILL from UPS today.
$24.75 for import taxes, I assume.

Update: Sadly, no news. The seller won't return my correspondance, and I've done everything I can think of as far as proving my case is concerned, on the other forum. I sent the dispute/acf forms off to the bank this morning. It'll be 5-8 days before I hear anything back from them.

I know some of you have been cross-posting this and the original thread to other forums. I'd like to extend my thanks for that and all the helpful advice that's been given, the more attention I can draw to this matter, the better. I really appreciate all the support from this community.

Haven't finished reading all 7 pages, but the seller seems a little... "special"

Like short bus special.

like many have said, only use credit cards on paypal. they are a bunch of scum that will auto deny claims.

besides, even if they approve your claim, they will only give you your money back as long as it is in the sellers account. basically, if he takes the money out immediately they give you what he has or an apology. they are satan incarnate to put it lightly.

this is false. sorry to call you out, but if the other person doesn't have the funds in his account (paypal), they will draw them anyway and render his/her account to a negative figure. the funds don't have to be actually available to perform a refund/chargeback. trust me, i've been through all this crap

I won a PP dispute and I only got a partial refund of $25 due to the seller's account being empty. 5 years later and the dispute is still open and I'm still waiting for the balance. Maybe the new protection follows different rules?
