Today sucked balls. Shitty day at the office. The usual. I was supposed to stop at Autozone on my way home to pick up a replacement axle for the Galant to be installed tomorrow night in preparation for rally school this weekend in California. Of course, I got all the way home and out of the car before I realized I forgot it, so back into the car I went, off to Autozone to pick up my axle.

I get less than two miles down the road before some kid decides he's gonna blindly fire a left turn off across my lane despite not being able to see me around the truck directly across from him wanting to turn left as well. It's been raining all fucking day. Phoenix drivers are worse in the rain than Minneapolis drivers in the snow.

I see him.
He sees me.
We both go "Oh shit."
He jams on the brakes to stop.
I see his car nose dive.
I go for the outside lane to avoid him.
He slides, decides he has to go for it, and guns it. He pulls right the fuck into my path.

I was trying my damndest to threshold brake while steering to avoid him, but in the end, nearly 4000lbs of Mitsubishi Galant t-bones his Kia Sephia sedan hard enough that it shows me its roof and hood, then my focus goes to my sunglasses which have been bouncing back and forth between my face and the windshield. Funny how, immediately following something so horrific, something as trivial as a pair of Walmart sunglasses becomes worth caring about.

I look back up in time to see that the Kia has spun 200* or so, and I have bounced back into the middle of the intersection.

Four people in the Kia. Driver gets out, shaken like me. I'm on the phone to 911. The thirteen year old girl sitting behind the driver gets out, eyes glazed over, blood dripping from her chin and cheek. The other thirteen year old girl in the backseat is crying and says she doesn't know if she can get out.

Fuck.

Three hours later, I'm home, starting to get sore, planning on going to urgent care in the morning to get checked out. Other driver was cited for failure to yield.

I only have liability on the Galant. Other driver couldn't get his insurance card out of the glove box after being hit on that side. I have to call him tomorrow to try and get his information. Wish me luck that it goes well.

I can fix or replace the Galant. I just hope the girls in the Kia are okay and home by now. Pictures tell the tale. I'm going to snap some hi-res pics tomorrow with Vanessa's Nikon.

That is a severe understand here in the valley. It rains so infrequently that the moment a single drop falls it's damn near grid lock and shit head driving. People here have ZERO idea how to drive in inclement weather here. It could be pouring in the mid afternoon and every fuck head with a silver car is driving without head lights, making maneuvers I would be skeptical about in dry weather, etc.

Just last week I was coming out of the mountains near Phoenix and it was pouring and the thickest fog I had ever seen. Seriously like 2 feet of visibility. I was leading a group of cars doing like 10 miles an hour and we were all content in doing that but every minute or so someone in an SUV would fly past us on the left doing 60+. Never mind the fact that I know they couldn't see anything but they were shoving so much water and air in our direction it caused me to nearly spin the car multiple times. 20 minutes of that and I just said fuck it. Pulled way off the road, had a few smokes and waited the storm out. I'm not going to fucking die because these people can't be safe.

That really sucks to hear Brian. I'm sorry about the Galant but in the end it's just a car. It could have been a million times worse.

Omg, hope you guys are alright.

I have liablity also and same thing happend to me but it was an old lady, she clipped my front passenger side. She was fault,plus her was expired and didn't have with. I got two grand from the accident.


Talk to your Insurance and Name and Number of the Police officer that took your report Down he should've gave you a card. If so, give that to your insurance agent. Your insurance will do th rest, Just keeping calling them like every other day,if they got a copy of the report.

Thats an automatic 12 points right there, that kid should lose his license.

Whats really cool about my agent Progressive, they know about these 2gen cars.

Three hours later, I'm home, starting to get sore, planning on going to urgent care in the morning to get checked out. Other driver was cited for failure to yield. I only have liability on the Galant. Other driver couldn't get his insurance card out of the glove box after being hit on that side. I have to call him tomorrow to try and get his information. Omg, hope you guys are alright. I have liablity also and same thing happend to me but it was an old lady, she clipped my front passenger side. She was fault,plus her was expired and didn't have with. I got two grand from the accident. Talk to your Insurance and Name and Number of the Police officer that took your report Down he should've gave you a card. If so, give that to your insurance agent. Your insurance will do th rest, Just keeping calling them like every other day,if they got a copy of the report. Thats an automatic 12 points right there, that kid should lose his license. Whats really cool about my agent Progressive, they know about these 2gen cars.

I suspect it's going to be totaled out. Passenger door was popped open somewhat and the unibody appears tweaked along the front fenders. Core support is pushed back so far that one of my slim, SPAL fans is broken against the stock 14b.

I'm going to find a way to be driving another GVR4 by the end of the month. This is bullshit.

Doctor's appointment at 1600hrs today for a full work up. Sore as shit right now.

Yeah it's good to start out nicely.

But remember- the insurance "adjuster" is there specifically to make sure you don't get what it's worth. They absolutely will, in every case, make lowball offers.

The key is that the settlements offered by insurance companies are just that- OFFERS. You don't have to accept. In fact the longer you keep it on your adjusters desk, harass him, call his manager, delay, etc. the better off your check will be.

Do not accept the first offer.

2 years ago a kid was doing 50 on my street should of been going 25 blew the stop sign cliped a car with a 6 month old baby in it bounced off it and into a wall totaled both cars. The kicker was he got out of his car and got into the face of the lady he hit. As she was trying to get the baby out of the car. After my neighbor told me what happend. I grabbed him by the head and face planted him on the ground till the cops showed up.

After the cop showed up I gave him the kid. As he was taking my report he asked me "get any shots in." I told him nope and he said "you should of" with a smile. I told him he could drive around the block once If he wanted.

First; GET TO THE DOCTORS OR EMERGENCY ROOM! Take my word for it. Gotta get this crap on paper. The wife went down for like 2 years (still not right) by a truck who hit her while she was sitting at a light. Their insurance would not be reasonable, HAD to lawyer up (and I hate the idea but we were forced to). The lawyer was so happy that there was a paper trail. Very easy case for him.

Also, glad to hear that their was no major human trauma. That shit will weigh on you, even though it wasn't your fault.

honestly if it wasent yoru fault i wouldnt have gotten out of the car. let the squad get ya. this way the cops deal with all the other guys parperwork and they just hand you a accident report. secondly there is an instant paper trail started that the insurance can reclaim.
when i got rear ended in the fall i had them pull me out of the car. (my neck was killign me and the hands were numb) $4000k (not including fixing the car) bill and some wiplash later i got the insurance to settle pick it all up cuz it was all on paper

At least you were able to still post brother! The Captain is right, DO NOT skimp on the medical evaluation here. And do not anything from the insurance company, not even a check until you are all settled up. Signing almost anything absolves them of any further responsibility. I hope the kids are ok too, I know I would freak out if it were my 13 year old.

Like someone said in the chat this morning (sorry I forgot who, all doped up today), even if you could buy luck, I couldn't afford it, or I would get broken luck in the box. emoji

I got a call from my guy at Progressive (who has been a freaking bad ass on my behalf, leading me to highly recommend Progressive to anyone else) telling me that the kid's told his insurance company that *I* ran a red light and that's why I hit him.

There is no left turn arrow at that intersection, so if the light was red for a mile, he would have been running it too. The light turned yellow right as I entered the intersection. There was absolutely no way ANYONE could have stopped short and missed him.

So now his insurance company has requested an official copy of the police report before they will even resume their investigation, which means they won't even bother with sending someone out to look at my car until such time as they accept liability. Nevermind the fact that their insured was issued a citation for failure to yield!

My guy told me that he has also requested an official copy of the report through his singular, required channel and that it might be five business days before he gets that copy. In the meantime, nothing happens. Hurry the fuck up and wait.

I am, as my friend Mike would say, super pissed. Here's this kid and his three siblings with three different last names, living in their FREE house (Habitat for Humanity), and I have to sweat balls about getting my shit fixed.

I am shaking, I am so livid about this situation. $220 for rally school this weekend down the drain...

Driggs, I know this won't help you much, but it is worth a shot. In Louisiana after you get in an accident it takes 5 business days before the people involved in the accident can get a copy of the police report. It is then another 10 business days after that before the insurance company can make a request for the police report. It might be in your best interest to see if you can get a copy of the police report. Then give it to your insurance agent.

I found this out after my friend Phil smoked a woman in his WRX that blew through a red light. He got lucky and had an insurance agent as a witness to the whole accident. She filled him in on the above information so that he could get his claim processed faster.

Doesn't matter in CA. I'm almost certain the same law applies in AZ. Our law specifically says you may not turn across lanes of traffic, enter an intersection, or block someone's right of way unless it is safe to do so. He made an unsafe turn in front of oncoming traffic, which always has the right of way. Doesn't matter what you did.

Again, there is no law in CA that prohibits entering an intersection on a yellow light. There's not even a law that says you can't be in an intersection after the light turns red. Only that you may not enter *after* it turns red.

What if during gridlock, 3 cars get stuck in the intersection, and the light turns red while they're still out there, blocking traffic?

Would the crosstraffic with the green light have the legal right to plow right into them? No.

Would the people stuck in the intersection have the legal right to plow into the car in front of them so they could safely leave the intersection? No.

Speaking strictly in legal terms, and for your future benefit as a driver, that is not true. If you had been going 15mph, you could have stopped short.

One could make a very weak argument that you were going too fast for conditions because you were not able to stop in the 20 feet or so you were given due to the mistakes of this driver.

However since you have the right-of-way, regardless of intersections, lights, or conditions, he is required to yield right of way to you at all times. He simply has to wait for higher priority traffic to pass, and make his turn across the right-of-way when, and only when, it is safe to do so.

It's his insurance's job to attempt to transfer the blame (or at least create enough doubt for you to accept a percentage settlement) onto you, using either the "too fast for conditions" or "ran a red light" so "you were breaking the law too" arguments. They're in the insurance business to make money, not pay it out.

Just let your insurance handle everything, this happens every time there's an accident. Don't talk to the opposite side, give everything you can to your own agent (keep copies for yourself), don't sign anything until you're sure its fair and you're happy.
