Every time I start trying to pursue the bitch that damn near ran me over while on my motorcycle, I get so damn pissed that I cannot fuckin think straight.

For those who don't know, I was hit by a car when the driver lost control on the freeway Friday, September 30th, 2005. I was on my motorcycle, which was totaled (2002 Limited Edition Hayabusa, worth roughly $8300). Luckily, I walked away with a posterior dislocated left shoulder that resulted in a torn labrum, and a few other scratches, bumps, and bruises.

Okay, on the police report, it states that her insurance was "lost in wreckage", but I later found the girl had no insurance. After more research, I found the car wasn't even hers.

So I got a lawyer to help out, shortly after he bailed because of the no insurance thing. I contacted the local law school for 'legal aid', but their advice was to obtain a lawyer for district/municipal court. When I explained that I tried that already, their answer was to pursue it in small claims court. Here in Bexar County (pronounced bear, for you non-Texans), the jurisdictional limit of small claims court is $5000, which makes me case not eligible due to the higher value of my bike. I called and talked to the lady's mom, who informed me her daughter had no insurance, and the owner of the car (who, according to her, was old, about to have open heart surgery and/or die) didn't have insurance on the car either.

It's a fuckin circle jerk! Then, I discovered a thing called the Bexar Co. Dispute Resolution Center, so I contacted them to set up an appointment. They contacted me last week and requested I contact the DPS Safety Responsibility office because they pursue people of damages are over $1000, and we're scheduled to meet tomorrow at 6pm. She also informs me that on September 1st, 2007, the jurisdictional limits of small claims court is raised to $10,000. Fuckin awesome, finally something worked out. Well, the lady calls me back and says the woman she spoke to remembers no accident and was quite old. I explained that it was her mom (or grandmother) and is the one who told me all the other crap from before. What a bunch of BS. So, I looked up this SR office of the DPS and found info on it and all seems great and I'm looking through the prereqs. Next thing I know, the time limitation prereq is 1 yr and 10 months. MOTHER FUCKIN SON OF A BITCH! I'm at 1 year and 11 months!

Why the fuck do I pay for insurance when it clearly means nothing to any of these fuckers?????? I could save my self several thousand dollars a year and just say screw you if I ever run into someone. GOD DAMN I FUCKIN HATE "THE SYSTEM"!!!!

I need to just leave work and go do something else...anything else...I'm so pissed.

1 year, 10 months, 22 days and the mother fuckin SR office won't have anything to do with it because it's "too old" when their website states 1 year and 10 months.

Fuckin bastards, I just got off the phone with them now.

I didn't have full coverage or UIM coverage. To fully cover a busa for 1 year was in the neighborhood of $3600.

Welcome to how the world works. The honest working man get f@#%ed for being a law abiding citizen while criminals hide behind the law. My brother hit some itiot that decided to run across a mini-highway a few years back. The insurance co. paid out a total of $83,000 to this turd and put my brother's insurance through the roof.

All kidding aside, it's an all too common problem. There should be more protection available to motorcycle riders when it comes to insurance coverage. Unfortunately due to the "average young motorcyclist" that is irresponsible and negligent your premiums for collision coverage is too expensive. Knowing you over the years I know your not in the same category of rider. Somehow people get through the loopholes of the law more often than not when it comes to driving uninsured. The insurance carrying taxpayers of this world are too often dicked over by the idiots of this country. Insurance companies have been given so much leeway over the years because of their high dollar lobbyists. Then they are able to charge insane premiums with no limitations. The legal system in this country does little to curb non-insured drivers from hitting the road, and in turn.. hitting fellow motorists such as yourself. Every day at my job I would see people DRIVE through the drive-thru with no license, and therefore no insurance. It's a sad, bullshit thing to deal with. Too bad you can't exact vengeance in a more fitting manner to the bitch that hit you, without the legal ramifications that would follow to you, the insured motorist. (yaa this subject ticks me off.. just a little bit)

I sent my paperwork in yesterday to the TX DPS with a long letter basically begging them to take the case.

I hope they do something about it, it is pretty shitty if the chick walks. However, I am partly responsible since I didn't put more effort into it sooner. I tried here and there to get more information, but would get so pissed I'd just stop. Not to mention that I had just started back in college, bought a house, and got married over the less-than-2-year time frame. Not that it's an excuse, it's just I had a lot going on and kind of forgot about pursuing this. I'm not sure how I stumbled across the dispute resolution, but I wish I would have found it sooner.

It basically came down to no one knowing what was available to help out a person in my position. I contacted everyone I could think of, and the only person to respond was my city councilman, which after looking at his e-mail just now, was actually really helpful. He's the one who suggested dispute resolution, who, in turn, recommended the SR office.

The "Troubleshooters" on the local TV news station said the DPS had programs for people in my situation, but just recommended I contact DPS. I did, and those people didn't know jack.

I feel like I'm finally getting somewhere with this, even though it's well over-due. Tonight, I've got an appointment at the Dispute Resolution Center where we're supposed to meet. I'm 99% sure the lady won't show up. Next step from there will be Small Claims Court, which I'm ready to do now, just waiting for the first business day of September before I can file.

I need to build a webpage to help educate others in my position.

Oh, and I forgot to mention, they're starting to be more tough on non-insured motorists here (San Antonio for sure, maybe TX, not sure). A few months after my accident, if you're pulled over without insurance, they tow your vehicle on the spot, no questions asked. Of course, 25-50% of drivers on the road here are without insurance, though. Texas is working on a system to link both registration and insurance when LEO's run your plate number to see if either are current. I think it's a great idea, but I like North Carolina (I think that's where it is). A buddy of mine said if you let your insurance lapse, they'd show up at your house to tow your vehicle. Why can't we have shit like that?

in NV, if you dont have insurance you cannot register your car... if you dont pay yoru insurance after registration, 30 days go by and you're registration is suspended and you get a $250 fine.....

imo, its good and bad... i've had to pay the fine b4 and was pissed....

In Indiana you can't register a car without insurance. You can't get insurance without a D/L. I wish we had the laws here were they would suspend your registration when insurance is no longer valid. It would take a lot of work to enforce it properly but it would be well worth it.

I have a valid solution to the no insurance policy.

Let's say I go take some classes at the state level and get a license to pull people's plates. Make it so that you cannot trespass on their property. Parking on a public street would be an ok area though. Once a week I would go to the DMV and pick up a list of people with no insurance in my region. I just drive by their home, find out where they work. Pull tags while they are away somewhere and leave. A car with no tags stick out in traffic.

Call a tow truck on the way out and have them come pick up the car. People will argue this method will negatively effect the working poor, but $40/month for minimum coverage isn't that much.
