Last month, I sold my 1997 eclipse Gs on craigslist for 1500 as is.
Well, I just a rude call from this kid. He stated the head gasket blew,radiator,something about it fail e-check etc. Then he this before he put a 100 miles on the car. He said he wants his money back or he'll sue.

I wrote on the listing, Clearly. It only needed a alignment, tires and valvcover leaked abit not Not too bad just needs resealed. autotransmission shifts great and great compression. Car was never raced or beat on.

Everything else was good and I tossed in an extra bumper and a box of extra's motor mount, Raditor hose kit thermostat with gasket, fuel filter, belts alternator-power steering and a upstream O2 sensor. New Timing belt and wtaer pump.

I told them both they're full of it, and I stated on the listing as is an what the Car needs or Didn't need.

Well, his lawyer told him he either sell it out of court or it going to small claims.

I personnelly think this is bullshit. I've printed out two copies of my listing I had on Cragslist to back up, what I wrote.

I think this jackass wants money period.

I strongly believe it would in my favor if this Crap goes to court.

Do you guys think he has a case, what you all think.

Did you get his signature on a bill of sale that stated "vehicle sold AS-IS no warranty" ?

If you did then there isn't shit he can do. If you didn't then it's your word against his in small claims court.

EVERY car I've ever sold has had a bill of sale that the buyer signed that stated the car is sold as-is, no warranty.

Sorry, about the errors. I'm just pissed off.

I was very honest with theis college kid, about everything what it needed and Didn't need.

My Aunt told me, as long as I had as is in the listing he can't do nothing. I sent cragslist an email about what to do waiting to hear back.

Motor runs strong NO Mechanical Problems. I do all my requried maintence on everything and I don't half ass it. Does have small Valve Cover gasket leak IT's nothing too serious. GAsket is New it just needs Re-Sealed with High Temp Sealent. Automatic transmission shifts great.

Great car for those starting out in DSM's and good work daily back up work car.

That's right, I told him as is over the phone and in person.

Car drove and idle good, except it needed an alignment-tires, VC needed resealed. He test drove with me in it and I was there when he filed the paperwork tranfered the title over. The BMV is two blocks is two blocks from my house. We both agreed for me to be there, to make it look legit. So, whatever happend it when the car left my house was his fault. Ever sense I've owned I wasn't required to do an E-check.

The kid screwed up big time. First, time he called my house he threatened to bashed my windows both house and cars. I had him on speaker phone when he called. My mother freaked out her blood went hay wire she's diabetic. I told the kid police response time is less than five minutes, police is two blocks from house. After this, I called my landlord, give him the kid's number. The buyer called back to appologized and told me he has an anger issue loses his temper easy.

Also, one more thing. When he introduce me to his Gf. I asked if they where married, just small talk. He replied with smart ass grin.

I know when two people get in engaged, there's money trouble before they finalize the marriage. We've been there, so was I but me and ex. went for it anyway. We both had to work togethere, that's what marriage is all about. But, this buyer messed up with that comment becuase now he's starting his crap and this can back fire on him, enter's Face Palm.

I've talked to my aunt from Florida asked her for advice about this before I started my thread. She told me exactly what you guys said and also to read up on cragslist about the policy. The great thing is that I stated as is in my listing. I went through the legal forums on CL, started a thread about this too. They've told me the same thing, it could happend to anyone and one person said. Next time get a bill made at point of sale with as is, with his signature on it, like a written receipt.

I've made copies of my listing of this sale from CL and thank go for caller ID. I have both the buyer's name/ number and his lawyer's also. It's all put in a file, just in case.

That's a bitch move, right there. Not a stretch to consider it assault (which threatening physical violence). You should have called the police to report this incident anyway.

Last time someone threatened me like that, he was a complete retard and left it as a message on my voicemail. The cell provider said they would keep the copy available for the authorities to review if requested.

Call the Police and explain the situation. Find your original listing (can you still pull it up from the edit email?), print it. Find the thread with the advice from the CL legal forum, print that too. Then present this information to the police officer you speak to. If he tells you he'll see you in court, call the court and confirm it. If he's just making threats and generally being a pain in the ass, call the police up again and, this time, let them know that he is constantly harassing you and would they please ask him to stop.

Failing that, find a large icicle while it's still cold out. Put it in your freezer and save it til summer. Then stab this motherfucker in the heart with it when nobody's looking. Ice melts, no weapon, no prints, no problem.

PS - Do not print this thread and show it to the police. That last bit (which was OBVIOUSLY a joke) won't help your case at all.

I meant the buyer wants to settle it out of court. Next time his lawyer calls back I'm telling him car was sold as is. Buyer knew this, in person and on the listing. He can deal with it his own and get fuck.

News. The Buyer called few minutes ago. He's pressing it, there's a court date set for end of next month.

I went ahead an emailed a free legal aid site here in Ohio. I recieved a call back within two minutes from my email. I told the guy my situtation. He said only way for there's a court date is if they mailed me a summons. Told him I didn't get one. So he appointed me an attorny.

I'll keep this updated, and will tommorrow noon. About this big mess up.

yeah you should get a summons in the mail detailing exactly what it is your getting sued for. the postal worker will have to hand it to you directly and youll then have to sign a bunch of stuff for verification. then youll have a limited time to get out a return statement of where you stand in the situation (21 days here in michigan). Whatever you do, i strongly suggest you get a lawyer if he has one. if he doesnt, you could battle with your word against his. should he have one, you will need one. they tend to not be in much favor of those who dont get a lawyer with the assumption your not really looking at this from a legal perspective. I wish you luck in this situation. Shop around for lawyers. Here in michigan, the avg pay for a lawyer is 160/an hour.

Wow, I thought a deputy sherif would deliver it to me in person. Hell, pd is just two blocks from my house. So, is the courthouse we could settle this there but no. With this type case, closes place is martinsferry, hour from me and a three hour for him.

I didn't recieve Jack! In the mail, this punk just called me give me the date time and location. After this information,I hung up him and didnt say jack to him.

Damn, that's actually not bad but I can't afford that. I'm going legal aid route, my aunt reccomend me to get since. I have much money due to hours being cut at work and paying child support. Total cost is less than fourty dollars.

I would call the court that the douchnozzle told you to show up at and find out if there really is a hearing scheduled because the kid may just be blowing smoke up your ass or he's trying to rope you into some kind of arbitration that he knows you won't be able to find, thereby leaving you on the short end of the stick that you can't fight. I've heard of it happening before. Old scammer trick.

Just got off the phone with the county courts north division from this location he gave.

They told, there's no information for a hearing for that day Also, either my name or his name and also they never heard of his lawyer's name too.

The clerk told me that I would receive a summons in mail from this county other information in regards to his claim.

One thing that stood out was This county courts would reject his claim and filing. He has to do it from his own county.


This is my first time selling anything on craigslist and will be my last.

well it could be a deputy that would deliver it or it could come in mail. im not sure about any other areas...but here in my county i can google clair county court dockets and theres a link right at the top in which you can enter and put in anyones last and first name (both required) and itll show a persons entire record within that county meaning it excludes anything done in other counties. so if anyone was to ever bring a civil suit against you, it would be in there. it would say "so-so vs. you" summons and complaint issued.

The kid, who I sold the car to. Was pulling an old CL scam trick, to get money.

Supposedly, there was a court set for the end of this month in another county about two hours from me. Martinsferry,OH

I searched the web for the phone number, to this munciple court. Turns out the clerk hasn't heard of name name or the plantiff. Clerk also said they wouldn't allow the to be held there from another county, it would tossed out of court, and I would've recieved asummons in the mail or deputy Sherif/ local police of my city/county would hand it to me in person. Hell, I live two blocks from alliance PD and the court house.

The legal service rep. who helped me find a attorney, told me exactly what the clerk said and everyone here, the legal forum on CL and my Aunt from Florida. I wasted 40 bucks for the legal service, just to find out. This Idiot was pulling an old craigslist scam.

Nothing else happend so far, this damn idiot who blew up my 97 gs can go beat some salt.
