I didn't file a return last year because there was an error on my W4 when it was filled out. SO, my question is, can I file this year and get my return, or do I have to be current on my returns to get my money back for this year?

you will have to file for last year due to not having filed before. The longer you wait to file, the worse it will be. IRS chargers interest and penalties for if you owe money. The bright side is that you might get money back. What was the error on your w4 or are you referring to your w2 that you get from your work in order to file?

Yes, it was my W2, somehow I ended up claiming 2 all year. So basically got screwed. I had an evil manager and can't prove that it was tampered with. Luckily the bitch got fired though. I think I'm just going to go to IRS.gov and file for free and send it in to them. That way I can just pay them for last year with this years return. I claimed 0 this year, so it will cover it. Thanks.

See your w4 is what you fill out when you are hired and some places have you fill out a new one each year. You can however take a look at your old w4 and see compare handwriting and that is one way to prove it was tampered with. your w2 is what you get that shows a total of your income and withholdings. If you lived down here, I would tell you to come by my office and I would take care of it for you so we could see what all you would get back and what you would owe. I would go ahead and file your 2008 tax information, or atleast fill out the forms and see what you will be owing. Do you have any dependants? If not a 1040EZ tax form is what you need to use. You can print a form on IRS.gov for it.
