Since I own Daisy lock-stock-and-barrell, if I chose to "do the work myself," they cut the check right out to me. I've got one estimate so far for almost $1700 worth of damage, but the car still drives just fine. It's just a lot of labor to pull giant dents out of the rear quarters, so what do you guys think?

If I do a first rate repair job on this damaged fender, then the other 75% of the car will still look tired and abused. She's a six-footer. Anything closer than 6ft and you see every blemish and ding.

I don't want to have her looking like ass, but this could be my ticket to bringing her to Ohio this August. Blessings in disguise...

Opinions, please? Am I crazy?

i know i don't post here much but if it were me i would do the bondo cause if you do a top notch job on just that part the rest of the car isn't going to look right. of course i am all about doing stuff half a$$ but then again i don't like my car as much as you probable do yours lol.

That's what I'm thinking...

*The same panel on the driver's side was similarly damaged about 4 years ago. The body work done was subpar, the color doesn't match perfectly, and I've noticed lately that the paint there is actually starting to lose it's shine. Not to mention some overspray on the hatch over there...

*The upper window trim on both doors is bent in several locations from a break in some 6 years ago now. At the same time, they pried my door locks all to hell. I wouldn't be surprised to learn you could unlock my doors with a pen.

*Both headlights have that shitty clearcoat flaking off them. They are nearly opaque, but they are not yellow yet.

*Passenger front fender has 1st rebuild gouge all the way to the sheetmetal in it from a "breaker bar" (read: section of trampoline frame) slipping off the wrench on the siezed up axle nut and spinning into the fender.

*Hood has a couple reverse dents in it from leaving the fuse box cover off on more than one occasion, then closing the hood on it. Also a nice area where some prior body work wasn't buffed perfectly. Nice swirlies on the hood.

*Black paint on the roof has been coming off on the chamois for years now. I bet I'm a year away from just polishing the sheetmetal with some Simichrome or Wenol.

*Black "paint" (it's more like a plastic coating) on the rear pillars is cracking and peeling at the base of the hatch.

*Front bumper skin has several locations where the paint is just falling off.

So, if I get this one fender redone to like new condition, then the rest of the car looks shittier. Now that the engine is built, I've got a little suspension work done and I've tracked down my brake upgrade, all that's left to do is boost her this winter (I hope) and then I plan on focusing my attention on the exterior clean up. Maybe it will be a tenth anniversary present for Daisy and I.

I think I would agree that there are very few people around here who love their car as much as I do my Daisy, but when it comes to doing things half-assed, well, I guess you just don't post over here enough to know who you're talking to. :+

I think you should take whatever money you get. Drive your Daisy un-fixed to the SO and buy everyone tons of booze so no one points and snickers at your tire rub marks.

Then race in the n/a class so again no one points and snickers that your excusing out again this year about brining Daisy.

So come on already fart knocker I want to compare slips on saturday with you and unless you bring it I will have to read how fast it is again all year long.

Local adjuster just came out and told me it looks like about $1000-$1100 worth of damage. Told me that I have a $1000 deductible and he is thinking that, at best, I will get $100 out of this to do the work if the policyholders in Tucson don't step up to the plate and accept responsibility for their dumbfuck son's girlfriend driving the truck.

I told him I'm not accepting that answer and I will be contacting the claims rep I've been speaking to to see what my options are. Daisy has been violated, and while I may not be intending to get her repaired 100%, the principle remains that you don't fuck with someone's car and then walk away scott-free. If I have to, I'm going to find a nasty lawyer, sue the girl, her boyfriend, and her parents. This is bullshit.

$100. What the fuck am I supposed to do with $100? That's a joke.

I've dropped an email to the attorneys my brother used when he was in an accident. I'm also still hoping to hear the people in Tucson recognize the girl's name as their son's girlfriend and say she had permission to drive the truck. Especially considering he has no license and she likely drives him to and from work...

Attorney says I should bitch and moan as far up the ladder as I can with the insurance company to get them to pay this claim.

Adjuster called and told me they only come up with $847. They're still talking $1000 deductible, so I'm only a short while from grabbing the lube, here.

Still, if I get this money, I'm bringing her out. If not, well, let's just say deej will have to deal with it. }(

you need to cancle the claim with your insurance co. and only make the claim on theirs. I went through that before and it worked out alot better for me in the long run. Why should your CO have to pay for someone elses mistakes. Their adjuster will com e out and your co will battle them for you if its an issue. I never make a claim on my policy unless its my fault even with a 50 dollar deductable.

We have the same carrier. I called a national claim center and filed. They had the truck owners' policy info on hand and the policy is current. I'm still waiting for the "investigation" in Tucson to be completed. If they deny the claim at that end, I'm raising Cain. (This is to say I'm after "their" insurance, but since they sent someone local out to inspect Daisy, it's somewhat tied to mine at this point.)

If you let someone borrow your truck (even a family member) and they live in another county, I would think it goes without saying that they have something of an understood authorization to make any decisions regarding the use of the vehicle. If the parents didn't want anyone else to drive the truck, then there needs to be a signed form saying that their son is the only authorized driver. If not, I think they should be liable. :shrug

I just know this is going to come down to me having to take them all to small claims court. They won't show, or they will, and I'm fairly certain I would win against at least one of them (the driver), but even then, I doubt I'd get shit in the end.

At this point, the thought of finding the truck and burning it to the ground sounds pretty good. Too bad I have probable cause and they have all my information... x(

This isn't over yet, but we all know how my luck tends to work.

Either way, it's not getting fixed.

Lady at AmFam called me to tell me she actually called up the chick who hit me and has a recorded conversation where the girl tells her the truck is HER uncle's and that SHE is BUYING it from him. Even goes so far as to say that she makes monthly payments to him for the truck and the insurance. My lady at AmFam tells me she is going to track down this adjuster in Tucson and share this information with her and ask when I might expect my fucking money.

It does not matter wether or not they have permission to drive the insured vehicle. If the driver of that truck is at fault for the accident then the company that insures that vehicle is liable to pay out of the property damage of that policy.

I'm sure you know by now that you have a couple options..

1) If you know shes at fault, You can file the claim through the insurance carrier of that truck and hope that they pay you for the damages. Now if they are insolvent then you...

2) File the claim with your carrier and let their lawyers work for you in Subrogating against the other company to get your deductible, In this case $1000, back for you as well as any money your carrier put out over your deductible amount.

3) If they are unable to subrogate against that trucks insurance carrier then you could go the next step which would be, like you said, small claims court. Now if you were awarded the money in court then you WOULD get paid because the court would force that persons insurance Co. to pay the Judgement out of that policy's Property Damage limits.

Good luck, I deal with this BS everyday. I know it sucks

Thanks for the advice, but as a "retired" insurance agent, I know all about the rules of coverage, subro, and small claims process. The problems arise out of the two vehicles covered by the same carrier and getting incorrect information from the girl who hit me. I know this sounds crazy, but I doubt I would sue my carrier if it meant they would drop me and I would have to get coverage elsewhere. My agent is that good.

Right now, I'm fairly certain I'll be getting some money out of this, but I'm waiting to hear from people with confirmation. I'll post up when I get the news...

I will certainly keep everyone posted.

That said, I just spoke with one of my contacts with the carrier and she said that they should be paying for the claim. Her recorded phone conversation with the driver stating that it's her uncle's truck, that she's been driving it and making payments on it for over a year now means there is no reason why they could claim she wasn't supposed to be driving it.

One thing that concerns me, though, is something I overheard when she was reading the notes in the system by the adjuster who looked at the car. Sounded like she read something like "wheel appears to have been damaged prior to accident." That is bullshit right there. I need to see this estimate the guy did. He was supposed to mail it to me. I never check the snail mail. :P

More as I get it...

UH OH.. Thats not good. They just recently implemented a claims adjusting process called " related prior " Which means they can now, LEGALLY, Subtract for prior damage, even if its has nothing to do with that incident that caused your damage,. It's complete BS.

So basically the adjuster would do this...

Estimate to fix damage caused by this recent incident= $1100
-Estimate to fix RELATED PRIOR damage to wheel = $450
-------
Total settlement paid to you = $650

This may not apply with your company, only some carriers have applied with the state insurance offices to do so.

Now I'm very interested to see what happens...

That IS bullshit, but the fact of the matter is, the damage to the wheel was caused by this accident. There was a nick on the lip in one location, which is painfully obvious due to it still having red curb paint ground into it. Otherwise, the wheel was flawless.

This might account for why the dealership body shop quoted me $1700 for the repairs and the carrier only said $850. :wary

Another phone call. Things are looking good. Delay with the adjuster out of Tucson comes from her having bad phone number for girl driving truck. My lady called her and told her the proper number, but also mentioned having the girl on tape as stating all that crap about buying the truck.

I asked if she had access to the estimate where I was quoted $800 or whatever and she just faxed me a copy. Totally left out the wheel. Replacement wheel is $125 + whatever to remount/balance and align the car. I'm going to call her back and tell her this needs to be addressed before they go cutting any checks.

Just another update.

You might not get them to pay for the wheel, but at least you, as the claiment, got the other company to pay and that can be hard to do, unless its like a cut and dry rear ending or something. So back to the original subject, Did you decide...what your going to do with the money?

Actually, I called the local adjuster and mentioned this to him. He said they could "send it out to be reconditioned." I told him I wasn't interested in "sending" my less than a year old wheels anywhere. He tried to reassure me that it would be as good as new and I woulnd't be able to tell the difference. They would even come to my house and take it off the car for me. I asked how much this would cost and he said about $150. I told him my wheels are $125 each, brand new. "Really?" Really.
