I'm pretty sure you can use it. Its probably a K&N copy anyway. Unless you have foam in it like a HKS filter. Is the filter all dirty and stuff?
If it's not that dirty just shoot an air hose at it or pat out all the dirt and dust.

I just K&N'd mine. I have a K&N tho. AEM CAI here. You can get a kit to clean and re-oil for around 10. I brushed mine off, cleaned it, and oiled the hell out of it. I oiled it so much, the filter is still dripping oil off! My gf's dad thought I had a tranny leak, cuz the filter oil is red, but I opened my hood to make sure and yeah, I looked under and saw it dripping from the filter. It feels like I just put it on now tho.

Use the K&N Recharger kit for 10 bucks. Don't spray an air hose from the outside or you may embed dirt even deeper into the filter element. Mine gets REALLY dirty after just a month, so I bet your's is filled with dirt after a year. The K&N kit is well worth it...
